Plaintiff Bobby Williams, a disappointed job-seeker, brought a discrimination action against defendant Hevi-Duty Electric Company under Title VII of the Civil Rights Act of 1964. In the judgment appealed from here, the trial court found that Hevi-Duty failed to hire Mr. Williams because of his race or color (a violation of 42 U.S.C. § 2000e-2(a)) and because he had filed a Title VII charge against Hevi-Duty earlier. (Discrimination against a job applicant for the latter reason would be a violation of 42 U.S.C. § 2000e-3(a).) We have found in the record no evidence that Hevi-Dutys failure to hire Mr. Williams violated the law in either respect. The trial courts conclusions were clearly erroneous, in our opinion, and we shall therefore reverse the judgment.
